Terms of Use

The use of the Portal of the Hellenic Data Protection Authority (hereinafter the “Authority”) is subject to the Terms set out below. The use of the Portal presupposes and implies that the visitor/user (or simply “you”) has/have studied, understood and accepted all the Terms of Use of the Portal. In the event that the visitor/user does not agree to these Terms, they shall refrain from making use of the services and content of the Portal.

These Terms of Use may be revised and updated at any time. Please check the Terms of Use of the Portal from time to time and in particular before taking any action based on the information, services or procedures contained therein.

Services to registered users

 

By using “taxisnet” codes, you can log in to the electronic services of the Authority in either as a Citizen or as an Organisation after having been registered properly.

When registering, the Authority only receives your basic identification information from the taxisnet user authentication service without having any other access to the data of this system. This information is automatically filled in by your account with the General Secretariat of Information Systems for Public Administration (GSIS). The details of the registration form cannot be modified, except by addressing the services of the GSIS.

As a Citizen you can submit complaints and requests for information through your account or subscribe to the list of Article 13 (article 13(3) of Law 2472/1997).

As an Organisation you receive services of a Controller or a Processor. In particular, through your account you can state the details of your Data Protection Officer (DPO), notify an incident of data breach and submit a request for prior consultation pursuant to Article 36 GDPR, a request for the provision of the list of Article 13 or any other request which lies within the competence of the Authority.

Managing your account, either as a Citizen or as an Organisation, you can track the progress of your requests, see all relevant supplementary documents and the history of the actions that have been registered, as well as modify your personal details. You can fill in your identity details in order to facilitate your identification. If you wish to lodge a Schengen/VIS/Eurodac complaint as a Citizen, it is necessary to complete all three fields for your exact identification in these systems.

As a registered user, you retain sole responsibility for any action carried out through your account. For this reason, you must ensure the security and confidentiality of your personal passwords and not notify them to third parties. In case you notice unauthorised access to your account, as well as any matter that concerns you regarding the management of your account, please contact the Authority at support@dpa.gr.

All the original content of the Portal, except for the official legislative Greek, European and international texts and the explicitly mentioned exceptions (possibly covered by copyright of third parties), which – indicatively – includes texts, graphics, images, photographs, drawings, presentations, videos, audio files, etc. (hereinafter Content) constitutes the intellectual property of the Authority and is protected by applicable national, European and international law.

The Authority shall retain all copyrights in respect of the Content of the Portal and any derivative works created under it.

The Content of the Portal shall be freely available to its visitors/users for any lawful use, provided that in the event of reproduction and reuse of the Content, this shall not be subject to any modification or alteration and shall be accompanied by a clear and distinct reference to its source.

The Portal has been developed with the open source Content Management System (CMS) Drupal under the terms of use of the GNU General Public License, version 2. It also includes PHP software, freely available. The Portal uses the “Robotto” font, which is available under the terms and conditions of the Apache License 2.0. The Portal also uses the “Font Awesome Free 5” font, which is available under the terms and conditions of the SIL OFL 1.1 license. Other intellectual works, as well as other products or services listed in the electronic pages of this Portal and bearing the marks of the respective organisations, companies, or other, public or private entities, shall constitute their own intellectual and industrial property.

Limitation of liability of the Authority – Disclaimer

 

The content of the Portal is available for information purposes and is not intended to provide advice on a particular case or to substitute the specialised legal advice that you should always seek in the context of the particular case you may encounter.

Portal information shall be provided for general information and should not be taken as an inducement to a specific action or refrain from action. You visit this Portal and take any kind of action based on the information contained therein on your sole initiative and responsibility. Although the Authority is making great efforts to ensure that all of the Portal’s information remains available continuously, is accurate and up to date, it cannot guarantee that the pages, services and the entire Content of the Portal will be provided without interruption, without errors, that errors will be corrected or that answers to all the questions posed will be provided. Under no circumstances shall the Authority be held liable for any damage suffered by the visitor/user of the Portal from the use or inability to use, the lack of availability or the non-update of its Content timely, as well as for the consequences of any act or omission of its visitors made as a result of the use of the Portal.

Similarly, the Authority, while making every effort to ensure that the pages and contents of the Portal are provided without viruses, does not guarantee that the Portal or any other website to which it refers or the servers through which content is made available to visitors/users is provided without viruses or other harmful components. The visitor/user of the Portal shall assume the relevant risk and any expense arising in any such case.

 

Use of links to third party websites

 

The Portal shall provide access to third-party websites, such as the European Data Protection Board (EDPB), Data Protection Authorities of other countries, as well as other entities, through appropriate links. These links have been included exclusively to facilitate visitors/users of the Portal, while the websites to which they refer are subject to their respective terms of use. The inclusion of the links is not an indication and should not be construed as approval, adoption or acceptance of the content of the respective websites by the Authority, which does not guarantee and bear no responsibility for the accuracy of their content or for the data protection policies they follow. If the visitor/user of the Portal decides to visit or use, through its links, one of the third party websites, they shall acknowledge and accept that they are doing so on their own responsibility.

 

Applicable law and other conditions

 

This text is the set of Terms under which the Authority makes the Portal available to its visitors/users. No amendment of these terms shall be taken into account and shall not form part of this agreement unless it has been formulated in writing and incorporated into it.  If any provision of the above terms is found to be contrary to the above legal framework or become inapplicable, it ceases to apply automatically and shall be deemed to have been removed from this text, without in any way affecting the validity of the other terms. The above Terms and Conditions of Use of the Portal, as well as any modification or alteration thereof, shall be governed by applicable Greek and European law.
